Conditions of participation
1. scope
These conditions of participation apply to all competitions organized by Memox Innovations AG, Reitergasse 9, CH-8004 Zurich. By participating, each participant accepts these conditions of participation.
This competition is in no way affiliated with Instagram or LinkedIn. It is in no way sponsored, endorsed or organized by Instagram or LinkedIn and does not give rise to any legal claims against Instagram or LinkedIn. All information relating to this competition is provided solely by the organizer.
2. participation
2.1 Any natural person in their own name with a minimum age of 18 years is eligible to participate. Participants who have already reached the age of sixteen but have not yet reached the age of majority may only participate in the competition with the consent of their legal guardians.
2.2 Minors under the age of 16 and persons incapable of contracting are excluded from participation.
2.3 The organizer reserves the right to exclude persons from participation who violate these terms and conditions of participation or who gain or intend to gain an advantage over other participants by improperly influencing or manipulating the competition. In such cases, the organizer may also subsequently exclude participants from the competition, withdraw prizes and reclaim them.
2.4 Participation is only possible within the period stated in the prize draw description. Each participant may only participate once in an identical sweepstake.
2.5 Employees of the sweepstake organizer, as well as employees of the companies participating in this sweepstake and their direct relatives are excluded from participation in the sweepstakes.
3. implementation of the lottery
3.1 Requirements for participation in the competition can be found in the competition entry form. The competition will be held during the specified period. All participants in the competition who meet the requirements set out in sections 2 and 3 by the respective time of the draw will be considered. Immediately after the end of the participation period, the winner will be drawn at random from among the participants.
3.2 A change or cash payment of the prize is excluded. The prize is not transferable.
4. profit handling
4.1 The winner will be notified by the organizer by e-mail or electronically, e.g. via social media. Depending on the competition, it is up to the organizer whether the prize must be sent or collected. With regard to the prize, each participant notified in this way is obliged to inform the organizer within two weeks of the notification being sent whether he or she accepts the prize. If the Organizer does not receive a corresponding message within this period, the possibility of accepting the prize shall lapse and the Organizer reserves the right to determine another participant and notify him accordingly.
4.2 If the contact details provided by the participant are incorrect (e.g. e-mail address), the organizer is not obliged to determine the correct data. The disadvantages resulting from the provision of incorrect contact data (e.g. incorrect e-mail address) shall be borne by the participant.
5. liability for defects
The organizer is only liable for damages incurred by the winner due to material defects and/or defects of title in the event of malice, intent or gross negligence. Otherwise, liability due to material defects and/or defects of title is excluded.
6. premature termination, adjustment or modification of the competition
The organizer is entitled to prematurely terminate, adjust or modify the sweepstakes at any time without prior notice and without giving reasons, if a proper execution of the sweepstakes cannot be guaranteed without appropriate measures for technical or legal reasons.
7 Applicable law
The law of the Federal Republic of Germany shall apply to all legal relationships between the parties. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

Responsible for data processing in connection with the competition is:

The named controller is jointly responsible for the data processing on the Instagram fan page on which the competition is organized, together with Instagram (platform operator is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) within the meaning of Art. 26 GDPR.
As well as for the data processing on the LinkedIn fan page on which the competition is organized, together with LinkedIn (platform operator is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland) jointly responsible within the meaning of Art. 26 GDPR.
8.1 Processing of your personal data in the context of the competition
We process your personal data for the proper implementation and processing of the competition and in particular for sending the prize.
In order to carry out the competition, the profile name and, if available, the first and last name of the respective participant are collected and stored. In order to send the prize, we also collect the surname and first name as well as the address from the winner(s) and pass this data on to a shipping company commissioned by us. Your data will not be passed on to third parties beyond this.
The legal basis for this processing of your personal data is Art. 6 para. 1 lit. b DSGVO (implementation of pre-contractual measures and fulfillment of a contract).
If we publish the first name and surname of the winner(s) separately on our profile or fan page or announce it externally, for example in our online store, this will only be done with the prior, express consent of the winner(s) pursuant to Art. 6 (1) lit. a DSGVO.
8.2 Storage period
After the end of the competition, your personal data processed as part of the competition will be deleted no later than three months after the end of the competition, unless there is effective consent for further processing (for example, with regard to the newsletter dispatch) and/or there is no continued legitimate interest on our part in the continued storage.
8.3 Your data subject rights
The applicable data protection law grants you the data subject rights listed below:
- Right to information according to Art. 15 DSGVO:
In particular, you have the right to obtain information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the intended storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it has not been collected from you by us, the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the logic involved and the scope and intended effects of such processing that concern you, as well as your right to be informed about what guarantees exist in accordance with Art. 46 DSGVO when your data is transferred to third countries;
- Right to rectification pursuant to Art. 16 DSGVO:
You have a right to immediate correction of incorrect data concerning you and/or completion of your incomplete data stored by us;
- Right to erasure according to Art. 17 DSGVO:
You have the right to request the deletion of your personal data if the requirements of Art. 17 (1) DSGVO are met. However, this right does not exist in particular if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
- Right to restriction of processing pursuant to Art. 18 DSGVO:
You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is verified, if you refuse the deletion of your data due to unlawful data processing and instead request the restriction of the processing of your data, if you need your data for the assertion, exercise or defense of legal claims after we no longer need this data after the purpose has been achieved or if you have objected on the grounds of your particular situation as long as it has not yet been determined whether our legitimate reasons prevail;
- Right to information pursuant to Art. 19 GDPR:
If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
- Right to data portability according to Art. 20 DSGVO:
You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller, insofar as this is technically feasible;
- Right to revoke consent given in accordance with Art. 7 (3) DSGVO:
You have the right to revoke your consent to the processing of data at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned unless further processing can be based on a legal basis for processing without consent. The revocation of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;
- Right to lodge a complaint pursuant to Art. 77 GDPR:
If you consider that the processing of personal data concerning you infringes the GDPR, you have - without prejudice to any other administrative or judicial remedy - the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, workplace or the place of the alleged infringement.
1. general
These conditions of participation and data protection information govern participation in competitions organized by Memox Innovations AG, Reitergasse 9, CH-8004 Zurich. Participation in the competition is only possible during this period. By participating in the competition, participants accept these conditions of participation.
Participants will not incur any costs for taking part in the competition itself. Participants may be charged costs by their internet provider, but memox has no influence over this. By participating in this competition, the participant agrees to these conditions of participation. The conditions of participation apply for the duration of the competition.
2. eligibility
The competition is open to all natural persons who are at least 18 years old, have unlimited legal capacity, have a permanent residence in Switzerland or Germany and are not employees or relatives of an employee of memox. Sweepstake clubs are not eligible to participate.
3. exclusion of certain persons
memox is entitled to exclude individual participants from the competition - even retrospectively - if there are important reasons for doing so, such as for example
- Violation of the conditions of participation;
- Incorrect, dishonest and unlawful content or information; or
- Procuring unfair advantages.
In the event of such or other important reasons, memox is entitled to retroactively deny and reclaim the service received from the participant and to take legal action.
4. multiple participation & procedure and implementation of the sweepstakes
Multiple entries are not permitted. Participation takes place via the booking request for a location in Stuttgart.
Participation in the sweepstakes is as follows:
The participant submits a request via the website and thus ends up in the selection. If the participant wins, he or she will be contacted by memox employees by telephone or e-mail to clarify any further information on the implementation of the planned event or similar.
If the information provided by participants is invalid, incorrect and/or incomplete, memox is not obliged to make inquiries as to the correct information or to contact the participants in any other way. Any disadvantages resulting from the provision of incorrect contact details shall be borne exclusively by the participants.
5. profit
You can win a table reservation in the Göckelesmaier tent at the Stuttgart Spring Festival 2025.
The winner will be chosen at random. The winner will be contacted by a memox employee by telephone or e-mail. A cash payment or an exchange of the prize is not possible.
6. data protection
Participation in the sweepstakes:
The collection, processing, storage and use of all personal data, namely first and last name, address, e-mail address, is carried out exclusively for the implementation and execution of the sweepstakes. The legal basis is Art. 13 para. 2 (a) DSG, as the data processing is necessary for the fulfillment of the sweepstakes. Data will only be transferred to third parties if this is necessary for the implementation and processing of the competition. After the end of the competition, but no later than 31.04.2023, the participation data will be deleted. This does not affect the storage and processing of data in the event of separate consent to receive the memox newsletter, see below.
Newsletter registration:
If participants register separately for a subscription to the memox newsletter, the personal data is additionally transmitted to the party commissioned to send the newsletter and a double opt-in procedure is triggered. The participants receive a separate e-mail in which they must confirm their consent. Only after this confirmation will the data be permanently stored for the newsletter dispatch.
The legal basis for sending the newsletter is Art. 13 para. 1 DSG, as participants expressly consent to the processing of their personal data for the purpose of receiving the newsletter. The data will be deleted immediately after receipt of a revocation.
Revocation of consent to receive the memox newsletter:
Participants may revoke their consent to receive further newsletters at any time by clicking on a link at the end of each newsletter, without incurring any costs other than the transmission costs according to the prime rates. The lawfulness of the processing carried out until receipt of the revocation remains unaffected.
General data subject rights:
Participants have the right to information about the data stored by memox at any time. They also have the right to correct the data and, if necessary, to restrict processing and delete it. Participants can assert their data subject rights vis-à-vis memox by e-mail at info@memox.com. Please note that the sender e-mail must match the log-in e-mail address of the participants.
In Switzerland, the Federal Data Protection Commissioner is responsible for data collections from public authorities and private companies or individuals.

The use of personal data for purposes other than those mentioned above or a transfer to third parties for advertising purposes by memox or one of the commissioned parties does not take place.
7. liability
memox will be released from all obligations after the end of the competition, unless an earlier point in time results from these regulations.
Liability on the part of memox for damages (direct or indirect damages, including lost profits or other expenses) is excluded to the greatest extent possible under applicable law. Liability for damages on the part of memox exists only if and insofar as damage is attributable to intent or gross negligence.
The above exclusion of liability applies in particular to damage caused by errors, delays or interruptions in the transmission of data, in the event of faults in the technical equipment or service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition. Liability under the Product Liability Act remains unaffected.
8. legal framework
These conditions of participation and the legal relationship between the participant and memox are governed exclusively by Swiss law, excluding international agreements such as, in particular, the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich, Switzerland. Should individual provisions be or become legally invalid, this shall not affect the validity of the remaining conditions of participation. There is no right to participate in the competition. The legal process for this is excluded. The benefit cannot be transferred.
9. contact
All questions, comments or complaints must be addressed to memox. Complaints relating to the implementation of the promotion must be submitted in writing to memox within 14 days of the reason becoming known, stating the promotion. Complaints communicated by telephone or late complaints will not be processed.
